Agreement

These Terms govern your use of the ExistemAI website and, where applicable, our services. If you do not agree, please do not use the site.

Our services

ExistemAI builds and operates AI marketing systems for owner-operated businesses. For retainer plans, the specific scope, deliverables, and fees are set out in your separate service agreement, which controls if anything here conflicts with it. For the Discovery Sprint, the terms below are the agreement.

Discovery Sprint

The Discovery Sprint is a fixed-scope, two-week engagement priced at $5,000, paid in full at purchase through our checkout. The two weeks begin at kickoff, which we schedule by email within one business day of receiving your completed intake form.

Deliverables: a lead-flow audit (week one), a market plan (by day 10 from kickoff), a build spec (by day 14), and a recorded owner handoff walkthrough, with a live call on request. Deliverables are provided as documents and recordings sent to the email you give us at intake. You keep all of them whether or not you continue with ExistemAI.

The Sprint fee is not refundable. Because the work begins as soon as intake is complete and the deliverables are yours to keep, we do not offer refunds, credits, or cancellations after purchase. If you have not completed intake yet, your Sprint stays open until you do.

The Sprint delivers research, a plan, and a specification. It does not include building or running the system; those are separate engagements. We do not guarantee any particular business result from the Sprint or from acting on its recommendations.

Engagement and fees

Retainer plans are billed on a monthly retainer with the minimum term and billing cadence shown at signing. Marketing-engine plans carry a longer minimum and a portion due up front; response plans carry a shorter minimum. Exact figures are confirmed in your agreement.

Advertising spend is separate from the retainer and is paid to the ad platforms through your own accounts.

What you own

Work we build for you transfers to you under the terms of your agreement. ExistemAI keeps its own underlying tools, methods, and know-how. You keep your data.

Third-party services

Our work connects to third-party platforms (ad networks, CRMs, scheduling, and similar). Their terms and availability are outside our control.

Disclaimers and liability

The site and information here are provided as is, without warranties. To the extent allowed by law, ExistemAI is not liable for indirect or consequential damages. Remedies are as set out in your service agreement.

Termination and governing law

Either party may end an engagement as described in the service agreement. These Terms are governed by the laws stated in that agreement.
